SMS Terms and Conditions

The Health Connector will be using texting or short message service (SMS) to communicate with you.  These are the rules that will govern how we use SMS to communicate with you, how much it will cost you, and how you can opt out.

Agreement by You

By agreeing to receive SMS from the Health Connector, you are agreeing to these terms and conditions.  If you do not agree to these terms and conditions, you can opt out of receiving SMS message by following the instructions below in the section titled “What if I want to stop receiving messages?”

How do I sign up?

 You can sign up at https://www.mahealthconnector.org/sms-updatesFollow the instructions there to give us your name, email address and cell phone number.  You will then receive a confirming text from 94253.  By signing up, you are certifying that you are over 18 years of age and that you are either the mobile phone account holder or you have the account holder’s permission to sign up.

What will it cost?

The Health Connector will not charge you for SMS.  You may be charged by your mobile (cell phone) carrier for each message that you send or receive.  Messaging and/or data use fees may apply, depending on the terms of your mobile subscription agreement.  You are responsible for all fees and taxes of any kind imposed by your mobile carrier.  If you have any questions about fees or taxes, check with your mobile service provider.

How many messages will I receive?

You should receive between one to three messages per month.  We will only send you SMS messages from the Health Connector.

What if I want to stop receiving messages?

You can text STOP to 94253 at any time to stop service.   If you want to opt back in after stopping, you can sign up again by following the steps outlined above in the section on “How do I sign up?”

Privacy Policy

Disclaimer of Warranties and Limitation of Liability

THE HEALTH CONNECTOR PROVIDES SMS MESSAGES AS A CONVENIENCE TO YOU FOR INFORMATION PURPOSES ONLY. TO THE EXTENT PERMITTED BY LAW, WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE MESSAGING OR CONTENT THAT YOU RECEIVE FROM US AND EXPRESSLY DISCLAIM ANY WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE.

The Health Connector  (which, as used herein, shall include any of its officers, directors, or employee) will not be liable or have responsibility of any kind for any loss or damage that you incur in the event of any failure or interruption of our SMS messages, or resulting from the act or omission of any third party involved in providing SMS messages, or from any other cause relating to your access to, inability to access, or use of the SMS messages, whether or not the circumstances giving rise to such event may have been within the control of the Health Connector or of any vendor providing software or services.  The Health Connector will not be responsible for any loss or damage that could result from interception by third parties of any SMS messages.  The Health Connector does not guarantee the timeliness, validity or completeness of any information made available to you through SMS messages for any particular purpose.  The Health Connector is not responsible and will not be liable for any other damages of any nature, including any incidental, special or consequential damages (such as lost profits or lost business opportunities), punitive damages, or attorney’s fees.

Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflicts of laws provisions.  Sole and exclusive jurisdiction for any action or proceeding arising out of or related to these Terms and Conditions shall be in a state court located in the Commonwealth of Massachusetts.  If for any reason a court of competent jurisdiction finds any provisions of these Terms and Conditions, or a portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect.  These Terms and Conditions constitute the entire agreement between the Health Connector and you with respect to SMS messages and it supersedes all prior or contemporaneous communications, agreements and understandings between the Health Connector and you with respect to the subject matter hereof.
